El propósito de este trabajo consiste en realizar un estudio comparado de la intervención estatal para mejorar el acceso a la vivienda en España, Inglaterra y Gales, por los problemas comunes que presenta la política de vivienda. En este sentido, se analizarán el sistema autonómico de expropiación temporal de viviendas y las órdenes de gestión de viviendas vacías o EDMOs previstas en la Housing Act 2004 de Inglaterra y Gales, que implican una trans- ferencia coactiva inferior. Con posterioridad a su análisis, examinaremos los elementos positivos y los defectos prácticos que presentan ambos instrumentos. Finalmente, se atenderá a la conveniencia de la incorporación de las EDMOs mediante un legal transplant en España y a las medidas alternativas que ambos sistemas jurídicos ofrecen.

The aim of this paper is to make a comparative analysis of state intervention in improving access to housing in Spain, England and Wales, because of their common difficulties regarding housing policy. To this end, we will make a comparative analysis of the regional system of temporary expropriation of hous- ing use and EDMOs provided in the Housing Act 2004 in England and Wales, which are less intrusive than comparable tools in Spain. After this analysis, we will examine the advantages and disadvantages of these instruments. Finally, we will consider the convenience of incorporating EDMOs in Spain as a legal trans- plant, and we review the alternative measures that both legal systems provide.
