    Punishing environmental crimes between positive law and prospective approach. About the International Monsanto Tribunal Legal Opinion of 18th April 2017. Initiated by the international civil society, the Monsanto Tribunal delivered a legal opinion on 18th April 2017 about the consequences of Monsanto’s activities on human rights and on environment. The Tribunal held that some of these activities violated fundamental human rights pursuant to relevant international rules. The Tribunal highlighted the need to change International law in order to improve the environmental protection. For instance, it recommended to create a new international criminal offence the ecocide and to broaden the criminal responsibility to legal persons.

    Créé à l’initiative de la société civile, le Tribunal international Monsanto a rendu, le 18 avril 2017, un avis consultatif concernant les conséquences des activités de la société Monsanto sur les droits de l’Homme et l’environnement. Sur la base du droit positif, le Tribunal confirme que certaines activités et pratiques de Monsanto portent atteinte à plusieurs droits de l’Homme protégés par les instruments internationaux. Mais, constatant les lacunes actuelles du droit international pour garantir une meilleure protection de l’environnement, le Tribunal propose, dans une démarche prospective, de consacrer un nouveau crime international d’écocide et d’élargir la responsabilité pénale aux personnes morales.
