El artículo procede al estudio del conflicto jurídico que ha llegado hasta el Tribunal de Justicia de la Unión Europea, que ha dictado sentencias el 9 de enero. El litigio se inicia con el despido de varias trabajadoras por sustracción de productos, utilizando la empresa como prueba la grabación efectuada mediante cámaras ocultas de vigilancia. Se debate desde el inicio del conflicto en el ámbito judicial sobre la validez de dicha prueba. Los tribunales españoles la aceptarán, mientras que el TJUE estimará parcialmente la demanda y declarará vulnerado el derecho a la vida privada reconocido en el artículo 8 del Convenio Europeo de Derechos Humanos.
The article examines the legal dispute which has reached the Court of Justice of the European Union, which has handed down judgments on 9 January. The litigation begins with the dismissal of several workers for theft of products. The company uses as evidence the recording made by hidden surveillance cameras. The validity of this evidence is debated from the outset of the dispute in the judicial sphere. The Spanish courts will accept it, while the ECJ will partially uphold the claim and declare the right to privacy recognized in Article 8 of the European Convention on Human Rights to have been infringed
