La cuestionable regulación penal de los delitos de financiación ilegal de partidos políticos

    La reforma realizada por la L.O. 1/2015 de 30 de marzo incorporó por primera vez en nuestro Código Penal el delito de financiación ilegal de partidos políticos, el cual constituía uno de los temas más conflictivos y cuestionados por la sociedad en relación con este tipo de organizaciones, desde el prisma sobre todo de su consideración copio una manifestación de la corrupción pública existente en nuestro país. Sin embargo, ni la técnica de tipificación, ni las conductas incluidas son las adecuadas para hacerle frente, sino que, por el contrario se ha efectuado una regulación incoherente, insuficiente, que dará lugar a importantes lagunas de punibilidad, así como a un serio cuestionamiento de su legitimidad penal. Por ello, el tema del presente artículo además de un análisis de los elementos típicos de cada uno de los delitos de financiación ilegal, se dedica a poner de relieve los aspectos más cuestionables y controvertidos de la regulación misma

    The reform realized by the L.0, 1/2015, of March 30 incorporated for the first time in our Criminal Law, the crime of illegal financing of political parties, which was constituting one of the topics most troubled and questioned by the society in relation with this type of organizations, from the perspective of his consideration as a manifestation of the public existing in our country. Nevertheless, neither the technique of criminalization, nor the conducts includes are adequate to face it, but, on the contrary has been made an incoherent, insufficient regulation, which will give place to important absences as well as to a serious question of his criminal legitimacy. Therefore, the subject of this article, in addition to an analysis of the typical elements of each of the crimes of illegal financing, is dedicated to highlighting the most questionable and controversial aspects of the regulation itself
