O estudo do sentenciar: a importância da análise do processo de decisão penal

    The study of judicial decisions has called the interest of scientific research, however, it has not been able to reach a consensual theoretical framework to explain that process. Also in terms of the studies evidence we find this lack of consensus. At a time when justice systems are in the focus of many criticisms, research should explore the process of sentence decision-making, contributing to the establishment of a scientific, systematic, rigorous and thorough knowledge, contributing to an objective and systematic image of this process. This work aims to contribute to the creation/strengthening of a line of research focused on the sentencing process, through a narrative literature review within the social sciences, clarifying the role played by legal factors and extralegal factors. There are Strong data in the literature that the extralegal variables exert direct and indirect effects on the sentences, being able to lead to discrimination effects on the defendants. We maintain that the study of this subject should consider all these influences in a complex way, bearing in mind the importance of clarifying the role played by legal and extralegal factors.

    O estudo das decisões judiciais tem convocado o interesse da investigação científica, no entanto, não se tem conseguido chegar a um corpo teórico consensual que explique o processo daquela tomada de decisão. Também ao nível dos resultados empíricos dos estudos se verifica essa falta de consenso. Numa altura em que os sistemas de justiça se encontram na mira de inúmeras críticas, importa explorar o processo de tomada de decisão sentencial, contribuindo para o estabelecimento de um corpo de saber científico, sistemático, rigoroso e aprofundado, providenciando uma imagem objetiva e sistematizada desse processo. Este trabalho pretende, por meio de uma revisão narrativa da literatura, auxiliar a constituição/fortalecimento de uma linha de investigação das ciências sociais sobre o processo de sentenciar, clarificando o papel exercido pelos fatores legais e extralegais. Existem, na literatura, dados robustos de que as variáveis extralegais exercem efeitos diretos e indiretos sobre as sentenças, podendo levar a efeitos de discriminação sobre os réus. Defendemos, então, que o estudo dessa temática deve perspectivar todas essas influências de uma forma complexa, clarificando devidamente o papel exercido pelos fatores legais e extralegais.
