  In this paper, private inclusive education in Brazil will be analyzed according to Kant’s categorical imperative and Otfried Höffe’s and Vicente Barretto’s interpretations of the categorical imperative of law. Faced with this problem, without exhaustive pretension, issues referring to disability studies are addressed, in particular the right to inclusive education in private schools. The general purpose of the present paper is to analyze if the freedom of the agent to make a decision by respecting the will and the freedom of the other, based on morality and under the aegis of universal legislation, can avoid conflicts and actions that violate the freedom and dignity of the other. It adopts bibliographic research with a deductive reasoning, typically theoretical, analytical and descriptive.

  Neste artigo, busca-se submeter a educação inclusiva privada no Brasil ao crivo dos critérios do imperativo categórico de Kant e do imperativo categórico do direito, de acordo com as interpretações de Otfried Höffe e Vicente Barretto. Diante dessa problemática, sem pretensão exaustiva, são abordadas questões relacionadas aos estudos sobre deficiência, em especial, o direito à educação inclusiva em escola privada. Como objetivo geral, a análise da possibilidade da liberdade de decidir do agente, mediante o respeito ao arbítrio e à liberdade do outro, com base na moral e sob o prisma de uma legislação universal, poder evitar conflitos e ações que violem a liberdade e a dignidade do outro. Adota-se, para o seu desenvolvimento, a pesquisa bibliográfica, com a utilização do método dedutivo, com caráter teórico, analítico e descritivo.
