The favor expressed by the second paragraph of article 47 of the Italian Constitution, to the access of popular saving to home ownership is integrated with consistency in the principles of the constitutional requirements. That program, judging from statistical data, seems to be largely carried out: it seems that Italians suits the saying �better the ownership of brick than the property of shares�. But the experience of seventy years of policies about home ownership shows more shadows than lights. In these years of crisis, where there are still large pockets of housing disadvantage, policy choices tend to re-configure the right to housing. Due to the necessary brevity of this work,the essay focuses on some figures recently enhanced by the legislator (in particular land and building loans, rent to buy, real estate funds for socialhousing). These are rules from Civil right that, in light of the principle of horizontal subsidiarity, offer the opportunity to re-read the second paragraph of article 47 of the Constitution.

Il favore espresso dall�art. 47, comma 2, Cost. per l�accesso del risparmio popolare alla proprietà dell�abitazione s�inserisce con coerenza nella trama del dettato costituzionale. Quel programma, a giudicare dai dati statistici, si direbbe in larga misura attuato: sembra proprioche agli italiani si addica l�adagio «meglio la proprietà del mattone chela proprietà dell�azione». Senonché l�esperienza di settant�anni di politiche per la casa mostra più ombre che luci. In questi anni di crisi, incui permangono sacche consistenti di disagio abitativo, le scelte di policy tendono a riconfigurare il diritto all�abitazione. Per economia d�indagine il saggio si sofferma su alcune figure di recente valorizzate dal legislator (mutuo fondiario e edilizio, rent to buy, fondi immobiliari per il social housing). Si tratta di regole privatistiche che, alla luce del principio di sussidiarietà orizzontale, offrono lo spunto per una rilettura dell�art. 47, comma 2, Cost.
