    Si examinamos las sentencias recaídas sobre supuestos de feminicidio acaecidos en el ámbito de la pareja, descubrimos que en un significativo porcentaje de aquéllas se aplica al homicida la atenuante de arrebato, obcecación u otro estado pasional semejante, prevista en el artículo 21 del Codigo Penal. En este trabajo se estudia dicho dato, poniéndolo a la luz de lo que sucede en otros ordenamientos jurídicos y llamando la atención sobre su carácter profundamente discriminatorio.

    In near 10% of the sentences on feminicide in Spain, the convicted got a lesser penalty, because of the application of the heat-of-passion circunstance. Exactly the same happens in the Common Law countries, where adultery is a ground for the application of the provocation defense-and, consequently, the convicted are charged of manslaughter and not of murder. In this essay the author examines the situation, arguing that both the provocation defense and the heat-of-passion circunstance are mechanisms for the maintenance of the hierarchy between genders.
