En la dogmática administrativa de los Estados modernos, la idea de interés público atribuye al Estado la titularidad de los recursos mineros a través de la categoría jurídica del dominio público. Sin embargo, ambas construcciones del vigente Derecho administrativo parecen vislumbrarse en la mentalidad intervencionista que, de los recursos mineros, tiene el poder imperial romano.
In the administrative dogmatics of modern States, the idea of public interest attributes to the State the ownership of mining resources through the legal category of the public domain. However, both constructions of the current administrative law seem to be present in the interventionist mentality that the Roman imperial power has about the mining resources.
