Resumen de Constitucionalización del sistema integral de verdad, justicia y reparación en Colombia: algunos comentarios sobre la participación política y la responsabilidad del mando

  Después de un conflicto armado de más de 52 años con las FARC, el 24 de noviembre de 2016 el Gobierno Nacional y el grupo guerrillero firmaron el Acuerdo Final para la Terminación del conflicto y la Construcción de una Paz estable y duradera. Con el objetivo de garantizar la existencia y coherencia del marco jurídico para la implementación de los diferentes puntos acordados en la fase de negociación, el Gobierno Nacional ha sometido al Congreso importantes reformas legales y constitucionales. En este marco, el 4 de abril de 2017 se profirió el acto legislativo No. 01, mediante el cual se agrega un título transitorio a la Constitución Política, conformado por 27 artículos. En el presente escrito se profundizará en: i) la participación política de excombatientes a la luz del derecho internacional y los derechos de las víctimas;

  y ii) las vicisitudes de la responsabilidad de mando; dos asuntos centrales que han sido objeto de análisis y discusión tanto por la opinión pública en Colombia como por la academia

  After an armed conflict of over 52 years with the FARC, on November 24, 2016, the Government of Colombia and the guerrilla group signed the Final Agreement for the Ending of Conflict and the Construction of a Stable and Durable Peace.

  With the objective of guaranteeing the existence and coherence of the legal framework for the implementation of the different points agreed in the negotiation phase, the National Government has submitted to Congress important legal and constitutional reforms. In this context, on April 4, 2017 Legislative Act No. 01 was issued, which added a transitional title to the Political Constitution, made up of 27 articles. This paper will focus on (i) the political participation of ex-combatants in the light of international law and the rights of victims; and (ii) the vicissitudes of command responsibility; two central issues that have been analyzed and discussed by both public opinion and academia in Colombia.
