  This article aims to analyze the relationship between the principle of public interest over the private interest and the fundamental right to strike. To begin, will be shown the conflicts about the principle of public interest over the private interest and its relationship with the protection of fundamental rights. As a result, the institute of strike of public servants will be presented, especially requested by public servants. At this point, little will be presented history of the regulation of this fundamental right in the Brazilian system, as well as some foreign experience. Finally, the positions of the Judiciary on the subject will be presented to see the relationship or separation than previously developed this relationship between the principle of public interest over private interest and the exercise of the fundamental right to strike of public servants.

  O presente artigo tem por objetivo analisar a relação entre o princípio do interesse público sobre o privado e o direito fundamental à greve. Para tanto, inicialmente serão apresentados os principais embates doutrinários a respeito do principio do interesse público sobre o privado e sua relação com a proteção dos direitos fundamentais. Na sequência, será apresentada o instituto da greve, em especial a requisitada pelos servidores públicos. Neste ponto, será apresentado pequeno histórico da regulamentação deste direito fundamental no ordenamento brasileiro, bem como algumas experiências estrangeiras. Por fim, serão apresentados os posicionamentos do Poder Judiciário acerca do tema, de modo que se possa verificar a relação ou afastamento do que se desenvolveu anteriormente nesta relação entre o principio do interesse público sobre o privado e o exercício do direito fundamental à greve.
