  Legal argumentation involves difficulties in understanding decipher the truth that is the product of a proposition coupled with fact. Hence the need to discuss the theories that govern these relations in order to understand the phenomenon of judicialization in Brazilian law with amparo in the Federal Constitution. The judicialization comes as a response to the existing anomalies in the Legislative and Executive Branches, due to the moral crisis that crosses the Brazilian State and the lack of popular representation of quality. To see the importance of the Judiciary in the political arena to preserve the integrity of the constitutional commandments, respecting the limits between the Powers and adjusting the public policies to the legal system, in order to guarantee the fundamental rights and guarantees to all citizens.

  A argumentação jurídica envolve dificuldades para se entender decifrar a verdade que é produto de uma propositura conjugada com o fato. Daí a necessidade de discussão quanto as teorias que regem essas relações para se entender o fenômeno da judicialização no direito brasileiro com amparo na Constituição Federal. A judicialização surge como resposta as anomalias existentes nos Poderes Legislativo e Executivo, por força da crise moral que atravessa o Estado brasileiro e a falta de representatividade popular de qualidade. Enxergar a importância do Poder Judiciário na seara política para preservar a integridade dos mandamentos constitucionais, respeitando os limites entre os Poderes e adequando as políticas públicas ao sistema legal, com o fim de assegurar os direitos e garantias fundamentais a todos os cidadãos.
