Resumen de Direito, Gênero e Literatura: sua aproximação a partir da obra de Clarice Lispector

  In this article, we aim to make an approximation between Law, gender and Literature to demonstrate that discourse based on androcentric parameters continues to be reproduced in the legal environment, where it should be imploded. For purposes of delimitation, it is used as the theoretical basis of two books by Clarice Lispector, entitled Laços de Famíla (Family Ties) and A hora da estrela (The Hour of the Star), a writer elected for being a woman and for her writing about the female condition. The importance of the relationship between these areas of knowledge lies in their complementarity in the process of humanizing society and the institutions of justice. It is based on the assumption that the works chosen reflect an ideology of reality regarding gender relations, as well as that the legal professional carries out a work of continuous interpretation and, for that, uses language and the representation of reality by means of words, in what can be aided by Literature to concretize a utopia: a more humanized justice. In addition, literature can help to fill in the omissions, gaps and the very silence in institutionalized discourses, including legal ones, so that such an approach must be encouraged.   Objetiva-se, neste artigo, fazer uma aproximação entre o Direito, gênero e Literatura para demonstrar que o discurso baseado em parâmetros androcêntricos continua sendo reproduzido no meio jurídico, onde deveria ser implodido. Para fins de delimitação, utiliza-se como base teórica de dois livros de Clarice Lispector, intitulados Laços de família e A hora da estrela, escritora eleita por se tratar de uma mulher e por ela escrever sobre a condição feminina. A importância da relação entre essas áreas do conhecimento está na sua complementariedade no processo de humanização da sociedade e das instituições da justiça.

  Parte-se do pressuposto de que as obras eleitas espelham uma ideologia da realidade no que se refere às relações de gênero, bem como que o profissional do Direito exerce um trabalho de contínua interpretação e, para tanto, usa da linguagem e da representação da realidade por meio das palavras, no que pode ser auxiliado pela Literatura para concretizar uma utopia: uma justiça mais humanizada. Além disso, a Literatura pode auxiliar a suprir as omissões, as lacunas e o próprio silêncio que há nos discursos institucionalizados, inclusive jurídicos, de modo que essa aproximação deve ser incentivada. O método de pesquisa utilizado é o bibliográfico.
