Resumen de Liberdade de expressão no Brasil: Princípio ou regra, na perspectiva conceitual de Robert Alexy?

  The aim of the present paper is to carry out a study on freedom of expression, in the conceptual perspective of Robert Alexy, evaluating whether it is a principle or a rule. For this purpose, a conceptualization on Fundamental Rights will be presented, as a result of a bibliographical and normative research pertinent to the subject, distinguishing what is a principle and what is a rule, as well as the freedom of expression, presenting some normative acts that deal with the subject.

  In addition, some judicial decisions will be presented, particularly those from the Federal Supreme Court, the Superior Court of Justice and some foreign courts.

  Finally, reasons will be presented that lead to the conclusion that freedom of expression is a principle or a rule.

  O objetivo do presente trabalho é realizar um estudo sobre a liberdade de expressão, na perspectiva conceitual de Robert Alexy, avaliando ser ela um princípio ou uma regra. Para tanto, fruto de uma pesquisa bibliográfica e normativa pertinente ao assunto, será apresentada uma conceituação sobre Direitos Fundamentais, distinguindo o que vem a ser princípio e norma, bem como a liberdade de expressão, apresentando alguns atos normativos brasileiros que tratam do tema. Além disto, serão apresentadas algumas decisões judiciais, particularmente do Supremo Tribunal Federal, do Superior Tribunal de Justiça e de algumas cortes estrangeiras. Por fim, será ressaltado se a liberdade de expressão é um princípio ou uma regra.
