Resumen de O combate à biopirataria brasileira: Uma análise legislativa

  This scientific reshearch aims to analyze the legislative framework regarding the preservation of Brazilian genetic heritage in relation to biopiracy. To do so, the study was initially divided into the conceptualization of genetic patrimony and, consequently, the definition of biopiracy, focusing on the situation faced by Brazil. Lastly, the existing legal sources will be analyzed in order to ascertain whether, in the light of the Socio-Environmental State, the Brazilian genetic patrimony finds enough legal protection to curb the practice of biopiracy. As for the Methodology, the Inductive Logic base was used, as well as Referent Techniques, Category, Operational Concept and Bibliographic Research.

  O presente artigo científico tem por finalidade analisar o arcabouço legislativo atinente à preservação do patrimônio genético brasileiro frente à biopirataria. Para tanto, o estudo foi dividido, inicialmente, na conceituação de patrimônio genético e, na sequência, na definição de biopirataria, com enfoque na situação enfrentada pelo Brasil. Por derradeiro, serão analisadas as fontes legislativas existentes, a fim de se averiguar se, à luz do Estado Socioambiental, o patrimônio genético brasileiro encontra proteção legal suficientemente necessária a coibir a prática da biopirataria. Quanto à Metodologia, foi utilizada a base lógica Indutiva, além das Técnicas do Referente, da Categoria, do Conceito Operacional e da Pesquisa Bibliográfica.
