Gestación subrogada, ¿cuestión de derechos?

    Estamos ante uno de los temas bioéticos más controvertidos del momento por su carácter disruptivo sobre el modo en que ha sido entendida y regulada históricamente la relación maternofilial, planteándose la posibilidad legal de disociar la gestación de la maternidad. Tras analizar las cuestiones éticas vinculadas a la gestación por sustitución podemos concluir que tenemos argumentos de peso suficiente como para recomendar mantener el vínculo entre gestación y maternidad, y de acuerdo con el informe del Comité de Bioética de España concluir que en todo caso una reforma de la Ley vigente debería estar orientada a lograr que la nulidad de los contratos sea también aplicable a aquellos celebrados en el extranjero, adoptando medidas dirigidas a prohibir la celebración de contratos de gestación por sustitución a nivel internacional.

    The surrogacy is a very controversial bioethics matter at the moment due to its disruptive character related to the way it has been comprehended and regulated the relation mother-child in the course of the history, considering the legal possibility of dissociating the gestation of maternity. After analyzing the ethic points linked to the replacement gestation we can conclude that we have heavy arguments to recommend keeping the link between gestation and maternity. According to the Spanish Bioethics Committee report we can conclude: a change in the current legislation must be orientated in reaching the nullity of contracts which are made in foreign countries taking steps to forbid the transnational surrogacy contracts.
