    This article focuses on offering a wide perspective on the institutional reform developing in Chile regarding the management of water resources, from its immediate legislative precedent to the latest reform discussion of the Water Code.

    To address these issues, this paper consists of three sections and one conclusion.

    The first section develops a brief introduction to the current status of water resources within the Chilean regulation and the causes of its deterioration.

    The second contains peculiarities of the current regime and its relation to public domain theory.

    Finally, the third section focuses on exposing the main proposed amendments to the Water Code and their progress.

    Lo scritto costituisce un’analisi del processo di riforma che in Cile sta interessando la gestione delle risorse idriche, a partire da una ricostruzione dell’assetto regolatorio previgente.

    L’analisi consta di tre parti e di alcune riflessioni conclusive. Nella prima parte si descrive la situazione idrica del Cile, in generale, e le cause del suo recente deterioramento.

    Nella seconda si riepilogano gli aspetti principali del regime corrente e la sua relazione con la teoria dei beni pubblici.

    Nella terza si riportano le principali proposte di riforma al Codice delle Acque dando conto altresì del loro stato di avanzamento.
