Resumen de THE ART OF GOVERNING THE EVIL AND THE GRAMMAR OF THE INHUMAN ON THE BRAZILIAN PENITENTIARY SYSTEM

  The article intends to raise the issue involving the relationship between the state and the incarcerated person, which includes violations of basic rights by the State. For this, the text uses the notion of the banality of evil of Hannah Arendt as reflective base to understand the attitude of the state in governmentality - from the concept of Michel Foucault - the Brazilian penitentiary system. The paper demonstrates that violations of fundamental rights are normalized to the State, as manager and guarantor of the system and enforcing rights, especially the fundamental, and make the direction of the performance of government tactics.

  O artigo tem como objetivo suscitar a problemática que envolve a relação entre o Estado e a pessoa encarcerada, a qual se compreende eivada de violações de direitos essenciais por parte daquele. Por isso, convocou-se a noção de banalidade do mal de Hannah Arendt como base reflexiva para se compreender a postura do Estado na governamentalidade – a partir do conceito de Michel Foucault – do sistema penitenciário brasileiro. Almeja-se demonstrar que as violações de direitos fundamentais se encontram normalizadas para o Estado, como gestor do sistema e garantidor da efetivação de direitos, principalmente os fundamentais, além de direcionarem o desempenho das táticas de governo.
