    Cuando las reclamaciones judiciales por abusividad, sustanciadas de manera habitual en el incidente de oposición a la ejecución hipotecaria, parecían agotarse en los motivos relativos a la nulidad por abusivas de las cláusulas de intereses moratorios y vencimiento anticipado, asumida la estimación retroactiva de las demandas, tramitadas a través del procedimiento declarativo correspondiente, por las que se interesa la restitución de las cantidades indebidamente cobradas por las entidades financieras por aplicación de las estipulaciones que limitan la subida de interés en los préstamos pactados con interés variable, se abre una nueva brecha reivindicatoria de los derechos de los consumidores que ahora reclaman a los bancos la devolución de los gastos generados por la constitución del préstamo hipotecario.

    When legal for abusiveness claims, substantiated on a regular basis in the incident of opposition to foreclosure, seemed exhausted on the grounds relating to the annulment by abusive clauses of moratorium interest and early maturity, assumed the estimate retroactive claims, processed through the corresponding declarative procedure, which is interested in the restitution of the sums unduly charged by financial institutions by application of the provisions that limit the rise of interest in loans agreed with variable interest, opens a new gap reinvidicatoria of the rights of consumers who now claim the banks refund of costs generated by the establishment of the mortgage loan.
