Resumen de A personalidade do agente e o dever de motivação das decisões: Manifestação do direito penal do inimigo.

  This research is about one of the legal conditions set out in Article 59 of the Brazilian Penal Code for the implementation of the sentence-based, that is, the agent’s personality. The study is intended to demonstrate the importance of the personality vector at the time of application of the penalty, if you can consider it unfavorable to the agent, and if the magistrate is sufficiently able to attest it. Nevertheless, it will be presented here the relevance of this legal circumstances motivating the conviction and what is its relationship with major lines of thought of the Criminal Law, such as the Criminal Law of the Author and the Criminal Law of the Enemy (Feindstrafrecht). So it will be seen if there may be a negative evaluation of the vector of personality and what are the consequences that will result from such a deed.

  A presente pesquisa versa sobre uma das circunstâncias judiciais estabelecidas no artigo 59 do Código Penal Brasileiro para a aplicação da pena-base, qual seja, a personalidade do agente. O estudo destina-se a demonstrar a importância da vetorial da personalidade na hora da aplicação da pena, se é possível considerá-la desfavorável ao agente, bem como se o magistrado é suficientemente capaz de atestála.

  Não obstante, será aqui apresentada a relevância desta circunstância judicial na motivação da condenação e qual a sua relação com grandes linhas de pensamento do Direito Penal, tais como o Direito Penal do Autor e o Direito Penal do Inimigo. Assim, verificar-se-á se pode haver a valoração negativa da vetorial da personalidade, bem como quais são as consequências que resultarão de tal feito.
