El nuevo divorcio contractual en Derecho francés, hijo ilegítimo de la reforma de modernización de la justicia

    Diversos modelos de divorcio extrajudicial se han venido implementando en diferentes países desde hace un tiempo a esta parte. El divorcio por contrato extrajudicial recientemente aprobado en Francia, en el que se centra este trabajo, más allá de simplificar la disolución del matrimonio, genera más problemas de los existentes hasta ahora. Partiendo de este nuevo divorcio francés y de la problemática que presenta, se realiza un breve estudio comparativo con el divorcio notarial español del que se diferencia, entre otros, en dos aspectos esenciales: el tipo de divorcio susceptible de ventilarse extrajudicialmente y el control a realizar por el notario.

    Various models of out-of-court divorce have been implemented in different countries for some time now. The divorce by out-of-court settlement agreement recently approved in France, in which this work focuses, beyond simplifying the dissolution of the marriage, generates more problems than the existing up until now. On the basis of this new French divorce and the problems that it presents, we make a brief comparative study with the notarial Spanish divorce. Among others, the main difference is based on two essential aspects: the type of divorce that can be decided out-of-court and the control to be carried out by the notary.
