Que un agente de policía puede recurrir al uso de la fuerza de forma justificada resulta incontrovertido. Ahora bien, ¿está jurídico-penalmente obligado a ello? ¿en qué medida es responsable en caso de omitir una conducta salvadora lesiva? ¿puede un ordenamiento penal imponer legítimamente un deber de protección cuyo cumplimiento exija en el caso concreto acabar con la vida de un ciudadano? A dar respuesta a estas tres preguntas se consagra el presente trabajo. Para ello, se analiza en primer lugar el fundamento y los límites de los deberes de protección de los agentes de policía en el ordenamiento español. Acto seguido se aborda el problema de la naturaleza jurídico-penal del deber que obliga a los agentes de policía a proteger a los particulares frente a hechos antijurídicos: ¿se trata éste de un deber de garante o de un mero deber de solidaridad (arts. 412.3 y 450 CP)? El presente artículo concluye examinando la legitimidad de un deber de protección policial que requiere en el caso concreto un uso letal de la fuerza "disparo final salvador".
While it is undisputed that a police officer can resort to the use of force to accomplish lawful objectives, the question remains: is he obliged to do so? To what extent is the police officer criminally liable if by refusing to use force he fails to prevent a crime? Can a criminal law system legitimately impose a duty of protection whose compliance may require, in an extreme situation, the killing of a citizen? This paper aims to answer these three questions. To this end, I first examine the rationale and limits of the protection duties of police officers in the Spanish legal system. Next, I address the problem of the legal-criminal nature of the police officer's duty to protect individuals against crimes: is it a duty of guarantor or a mere duty to carry out so-called "easy rescues" (Arts. 412.3 and 450 CP)? The paper concludes by examining the legitimacy of a duty to protect which may require the use of lethal force.
