  The study aims to verify the (dis)similarities between the register of stillborn and born alive with immediate death granting specific attention to the name of the registrant. Initially, the legal treatment of the name as an element of public records is established, analyzing the state regulations regarding the (im)possibility of naming the stillborn. Subsequently, the motivation of the unequal treatment regarding the attribution of name to the stillborn and born alive registrant with immediate death is verified, taking into account the similarities and differences between the registries. Lastly, it ponders about the application and adequacy of the elements of born alive registry to the stillborn registry.

  O trabalho objetiva verificar as (des)semelhanças entre os registros de natimorto e de nascido vivo com óbito imediato, conferindo específica atenção ao nome do registrado. Inicialmente, estabelece-se o tratamento jurídico quanto ao nome como elemento dos registros públicos, analisando as normativas estaduais quanto à (im)possibilidade de atribuição de nome ao natimorto. Em momento posterior, verifica-se a motivação do tratamento desigual quanto à atribuição de nome ao registrado nos assentos de natimorto e de nascido vivo com óbito imediato, levando-se em conta as semelhanças e diferenças entre os registros. Por fim, pondera-se sobre a aplicação e adequação dos elementos do registro de nascido vivo ao registro de natimorto.
