    It is the aim of this article to address the design of the new family institutes that continually change Brazilian legal system, adding new concepts and legal challenges as regards humanity’s contemporary aspirations. As theoretical framework, we analyze the perspectives of the family model from the constitutional text, with an analysis of legal and common law marriages. The legal obligation of the spousal consent and its impact and (in) applicability, as far as the NCPC goes, are examined in the light of objective good faith of contracts. We used literature and deductive method, and by the thematic, theoretical and interpretative analysis, we suggest solutions to the posed question.

    É objetivo deste artigo abordar os institutos da nova concepção de família, que alteram continuamente o ordenamento jurídico brasileiro, trazendo novos conceitos e desafios jurídicos frente aos anseios contemporâneos da humanidade. Como marco teórico, analisam-se as perspectivas do modelo de família a partir do texto constitucional, discorrendo-se sobre os institutos do Casamento e da União Estável. Examina-se, à luz da boa fé objetiva dos contratos, a obrigatoriedade da Outorga Uxória do companheiro, sua repercussão e (in)aplicabilidade diante do NCPC. Utilizou-se a pesquisa bibliográfica e o método dedutivo, e, através da análise temática, teórica e interpretativa, sugere-se soluções à questão proposta.
