La Corte Interamericana de Derechos Humanos es un tribunal internacional regional y especializado, el cual emite sentencias que representan obligaciones para los Estados. Después de emitir una sentencia internacional, existe la posibilidad de regresar a un tribunal interno para exigir su cumplimiento a las autoridades internas. El presente trabajo aborda la problemática derivada de este regreso al fuero interno. Para ello se describirá la forma en que la Corte Interamericana dicta reparaciones y posteriormente se hará referencia a un caso que regresó a la Suprema Corte de Justicia de la Nación con la finalidad de analizar los problemas relacionados con la solicitud de ejecutar una sentencia interamericana.
The Interamerican Court of Human Rights it is a specialized, regional, international Court, it emits judgements that represent obligations to the States. After the issuing of an international judgement, there is the possibility of returning to the domestic court to demand the fulfillment of this judgement to the local authorities. These decisions have resulted on a great impact in the American continent but also have represented considerable problems in different countries. The present paper addresses the problems that derive from the action of returning to the domestic court to execute the judgements issued by the interamerican Court. To fulfill the mentioned objective, this paper will describe the manner in which the Interamerican Court of Human Rights emits reparations and, after, a specific case resolved by the Supreme Court of Justice of the Nation will be analyzed to witness the problems that derive from the request of the execution of an Interamerican judgement.
