En México existe un nuevo paradigma en materia de derechos humanos y en las correlativas obligaciones estatales de respeto y garantía de estos derechos a partir de la reforma constitucional de junio de 2011. El artículo primero constitucional establece la obligación general de garantía de los derechos humanos, así como sus componentes específicos: prevenir, investigar, sancionar y reparar. Asimismo, el artículo primero contiene dos mandatos claves: la interpretación conforme y el principio pro persona. Consideramos que existe una estrecha relación entre la obligación de garantía de los derechos humanos y la cláusula de interpretación conforme y el principio pro persona.

In Mexico exists a new paradigm in human rights and the correlative state obligations to respect and guarantee these rights from the constitutional reform of June 2011. The first article of the Constitution establishes the general obligation to guarantee human rights and the specific components: prevent, investigate, punish and repair. Also, the first article contains two key warrants: the pro person principle and the consistent interpretation clause. We believe that there is a close relationship between the obligation to guarantee human rights and the pro person principle and the consistent interpretation clause.
