  This article changes the Civil Code by Law No. relates. 13.146/2015 establishing the Statute Person with Disabilities. The rationale of this study stems from the advance to the dignity of the person protection with intellectual impairment, the new legislation amending and repealing some Civil Code articles relating to the person's ability, bringing in your text large structural and functional changes in the old theory of civil disabilities : absolute and relative, and the capacity is the ability to exercise legal acts and businesses and personality is the subject attribute inherent in its nature, since its inception, which affects directly to family law institutes, like marriage, interdiction and trusteeship. This study therefore focuses on the understanding of the supposed extinction of interdiction action with the entry into force of the new statute, which was the previous command, become a rule, fully able to civil law, aimed at their full social inclusion, for the sake of their dignity.

  Este artigo está relacionado as alterações do código civil pela Lei nº. 13.146/2015, que institui o Estatuto da Pessoa com Deficiência. A justificativa deste estudo decorre do avanço para a proteção da dignidade da pessoa com insuficiência intelectual, a nova legislação altera e revoga alguns artigos do Código Civil relativos à capacidade da pessoa, trazendo em seu texto grandes mudanças estruturais e funcionais na antiga teoria das incapacidades civil: absoluta e relativa, sendo que a capacidade é a aptidão para o exercício de atos e negócios jurídicos e a personalidade é o atributo do sujeito, inerente à sua natureza, desde o seu início, o que repercute diretamente para institutos do direito de família, como o casamento, a interdição e a curatela. O objetivo deste trabalho, por conseguinte, focaliza o entendimento sobre uma suposta extinção da ação de interdição com a entrada em vigor do novo estatuto, das quais tratava o comando anterior, passam a ser, em regra, plenamente capazes para o direito civil, o que visa a sua plena inclusão social, em prol de sua dignidade.
