Atypical contracts, once considered an exception, are becoming increasingly prevalent, thanks to a law tending to identify the worthiness of protection to lawfulness. There are many examples of this category of contracts, each of which has, here again, several subspecies (think of the lease, sponsorship, merchandising, co-marketing, the catering, the bartering, the know-how contracts, futures and swaps). The trend is however to pull any atypical contract tino a typical contract, from which borrow the discipline, or, in the case of mixed or complex contracts, to identify a prevalent type (absorption criterion) or to apply the discipline of the typical contract more suited to each service covered by the contract (typological criterion). This transaction allows not only to make up for the deficiencies in the discipline set by the parties but also to establish the same borders of the contract and, therefore, the contractual liability
