La Iniciativa Ciudadana Europea: un instrumento democrático en progresiva consolidación

    Tras su consagración en el Tratado de Lisboa y su desarrollo por el Reglamento 211/2011, la iniciativa ciudadana europea (ICE) todavía no ha desplegado todo su potencial, tanto por el escaso número de iniciativas que han prosperado como por la tibia respuesta de la Comisión ante éstas. El TJUE ya ha tenido oportunidad de precisar el alcance de algunos de los aspectos formales relacionados con el registro de una ICE, en particular la obligación de motivación, así como los aspectos sustantivos más relevantes del test de admisibilidad; además, ha proclamado la importancia de la ICE para la consolidación de la ciudadanía de la Unión y su funcionamiento democrático. Esta jurisprudencia, unida a las valoraciones críticas expresadas por otras instituciones y por los órganos consultivos, está propiciando un cambio de actitud de la Comisión Europea hacia una mayor flexibilidad en la ponderación de las propuestas de iniciativa ciudadana, que ha tenido reflejo en su reciente propuesta de revisión del Reglamento, lo que abre una oportunidad para mejorar esta herramienta mediante la incorporación en su regulación de elementos que propicien y faciliten su utilización.

    Following its consecration in the Lisbon Treaty and its development by Regulation 211/2011, the European Citizens' Initiative (ECI) has not yet achieved its full potential, because of the limited number of initiatives that have been successful and because of the Commission before them. The ECJ has already had an opportunity to clarify the scope of some of the formal aspects related to the registration of an ECI, in particular the obligation to state reasons, as well as the most important substantive aspects of the admissibility test. In addition, it has proclaimed the importance of ICE for the consolidation of citizenship of the Union and its democratic functioning. This jurisprudence, together with the critical assessments expressed by other institutions and the consultative bodies, is leading to a change of attitude by the European Commission towards greater flexibility in the weighting of the citizens' initiative proposals, which has been reflected in its recent proposal of revision of the Regulation, which opens an opportunity to improve this tool through the incorporation in its regulation of elements that propitiate and facilitate its use.
