A pesar de las innovaciones que supuso para el Ministerio Fiscal la Constitución de 1978, su naturaleza y sus relaciones con el Poder Ejecutivo, Legislativo y Judicial siguen constituyendo unas de las grandes cuestiones que afectan a la institución. Para que el Ministerio Fiscal asuma mayor protagonismo en el proceso penal, resulta indispensable clarificar su naturaleza y delimitar, con contornos nítidos y transparentes, sus relaciones con los tres poderes clásicos del Estado.
Despite the innovations the 1978 Constitution meant for the Department of Public Prosecutions, its nature and its relation with the Executive, Legislative and Judicial remains as one of the major issues that affect the institution. For the public prosecutor to assume a greater role in the criminal process, it is essential to clarify its nature and delimit, with clear and transparent outlines, its relations with the three classic powers of the State.
