La obra plástica en el límite de cita: los requisitos del artículo 32.1 de la Ley de Propiedad Intelectual

    El límite de cita de obra plástica ha sufrido un rechazo en su aplicación por suponer una reproducción parcial, infractora del derecho moral a la integridad. A este efecto, el artículo 32.1 de la Ley 1/1996 de propiedad intelectual distingue las «obras aisladas» para responder a una suerte de preservación del derecho moral de integridad. La lectura del precepto ha de atender a una interpretación integradora, porque nada impide que una obra plástica puede fraccionarse para su análisis, comentario o juicio crítico, siempre que se respeten los restantes requisitos. Tampoco puede plantearse una figura de «cita» independiente del análisis, comentario o juicio crítico, porque contribuye al erróneo entendimiento de que la obra de ilustración sea una modalidad de cita. En verdad, cuando la ilustración persiga una finalidad ornamental mediante láminas referentes al texto donde se inserta, nace una obra independiente de la escrita, desprovista de sujeción al límite y bajo el ejercicio exclusivo de su titular.

    The quote of the plastic work has suffered a rejection in its application because it supposes a partial reproduction, which infringes on the moral right to integrity. The article 32.1 of the Intellectual Property Law distinguishes «isolated works» in order to respond to a kind of preservation of the moral right to integrity. The precept has to attend to an integrative interpretation, nothing prevents a plastic work from being broken down for its analysis, a critical judgment according to the other requirements of article 32.1. And it can not be understood as a figure of «quotation» independent of analysis, a commentary or critical judgment, because it contributes to the wrong understanding of the work of illustration in a modality of quotation. When the illustration pursues an ornamental purpose by means of sheets referring to the text where it is inserted, a work is presented independently of the writing, devoid of subjection to the limit and under the exclusive exercise of its author.
