The author considers recent rulings of the Netherlands Supreme Court and the Court of Appeals of Amsterdam, which appear to confirm, albeit on different grounds, that the ECJ's decision in the Bosal case does not apply to participations in subsidiaries resident in countries that are not Member States of the European Union or the European Economic Area.
