Resumen de A crise da atividade jurisdicional e o hiperencarceramento como resposta estatal

  Impunity is seeing as the main cause of insecurity, although mass incarceration contrasts with violence drop. In this scenery, the aim of this work is to demonstrate the link between the crises of the modern jurisdiction model and hipper incarceration solution, their relation and consequences. The method to be used is deductive, and the adopted research technique is the bibliographical and documentary. As such, it contextualizes the historic moment when the State monopolizes the activity, based on modern paradigms. Thereafter, the adjudication crises scenery is presented, which has direct relation to the new challenges, forwarded to the appreciation of the legal states commitment, not molded to cope with them. Finally, the way the State reacts to the crises is analyzed and criticized for using the hipper incarceration to satisfy the punitive wishes of the people Who suffer from large influences of the media and to justify its monopoly when using the legitimate violence.

  A população vê a impunidade como a causa da insegurança, ainda que o encarceramento em massa consequente não resulte na queda da violência. O objetivo do presente artigo, nesse cenário, é demonstrar a ligação entre a crise do modelo jurisdicional moderno e a solução do hiperencarceramento, e tratar criticamente essa relação e suas consequências. O método a ser utilizado é o dedutivo, e a técnica de pesquisa adotada é a bibliográfica e documental. Dessa forma, no presente artigo contextualiza-se o momento histórico em que o Estado apropriou-se do monopólio da atividade, baseado em paradigmas modernos. É apresentado, após, o cenário de crise da prestação jurisdicional, o qual tem relação direta com os novos desafios postos à apreciação do Estado-Juiz, o qual não foi moldado a enfrentá-los. Finalmente, é analisada e criticada a forma como o Estado reage à crise: através do hiperencarceramento, para satisfazer o anseio punitivista da população, fortemente influenciada pela mídia, e para justificar seu monopólio do uso da violência legítima.
