Resumen de A (des)legitimação do sistema penal e os direitos humanos na era do biopoder

This present study aims to discuss the relationship between human rights, biopower and penal system, pointing to the necessity to politicize the criminal matter and human rights. From the look of biopolitics (in its biopower expression) and critical criminology, it is intended to problematize the discourses and practices in the name of human rights against the uncontrolled growth of the penal system devices such as the prison, noticing how the ideology of human rights can be compatible with the exercise of punitive power and, on the other hand, from a critical perspective, how human rights can be thought of in terms of counterpower and resistance in the face of the brutal violence of the punitive power in Brazil and in Latin America.

O presente trabalho tem como objetivo problematizar a relação entre direitos humanos, biopoder e sistema penal, chamando a atenção para a necessidade de se politizar a questão criminal e os direitos humanos.A partir do olhar do biopoder (na sua expressão biopolítica) e da criminologia crítica, pretende-se problematizar os discursos e práticas em nome dos direitos humanos frente ao crescimento desenfreado dos dispositivos do sistema penal, como a prisão, observando como a ideologia dos direitos humanos pode ser compatível com o exercício de poder punitivo e, por outro lado, como, a partir de um olhar crítico, os direitos humanos podem ser pensados em termos de contrapoder e resistência diante da violência brutal do poder punitivo no Brasil e na América Latina.
