Resumen de Privatização de presídios e a mercantilização do crime e da pobreza

This article discusses the privatization of prisons, including the phenomenon as a process of commodifi cation of crime. Therefore, it analyzes the Brazilian prison system, in order to highlight their main problems, especially its racial and social selectivity. It demonstrates the inherent relation between deprivation of liberty and the capitalist system, reinforcing its role of social control. In a scenario of fear and public clamor for shortsighted responses, the privatization of prisons appears as supposed advantage. In light of these assumptions, it analyzes the processes of privatization in the United States and France, to address critically its supposed benefits. It discusses obstacles in the legal, ethical and moral framework, especially the unconstitutional delegation of the punitive power of the state to the private sector, obtaining profi t with the suffering of others and by giving priority to profit to the detriment of the interests of prisoners. Finally, aware of the Brazilian reality, there is a critical analysis of the fi rst public-private partnership in the country. Thus, the privatization of prisons sets true commodifi cation of crime, once it reduces the human being, the crime and the poverty to market objects.

O presente artigo aborda a privatização de presídios compreendendo o fenômeno como um processo de mercantilização do crime. Para tanto, analisa-se o sistema prisional brasileiro, de forma a evidenciar suas principais problemáticas, especialmente sua seletividade racial e social. Demonstra-se a inerência da pena privativa de liberdade ao sistema capitalista, reforçando seu papel de controle social. Em um cenário de medo e clamor públicos por repostas imediatistas, a privatização dos presídios aparece como suposto préstimo. À luz dessas premissas, analisam-se os processos de privatização nos Estados Unidos e na França, países pioneiros, para abordar de forma crítica suas supostas vantagens. Destacam-se óbices no âmbito legal, ético e moral, em especial pela delegação inconstitucional do poder punitivo do Estado ao setor privado e pela obtenção do lucro com o sofrimento alheio em detrimento dos interesses sociais. Por fim, com atenção à realidade brasileira, faz-se uma análise crítica da primeira parceria público-privada em presídio do País. Dessa forma, a privatização dos presídios configura verdadeira mercantilização do crime, uma vez que reduz o ser humano, o crime e, consequentemente, a pobreza a objetos de mercado.
