    Resumen. El mundo de hoy nos muestra, por un lado, un tránsito de un Estado legislativo a un Estado constitucional y, por otro, un tránsito de un Estado de bienestar, que había sustituido al Estado liberal de derecho, a un Estado subsidiario. Esto lleva a una preocupación especial por el bien común y por la eficacia en la actuación estatal, lo que produce un cambio en los cometidos del Estado y en la forma de su consecución y muestra un relacionamiento público-privado distinto del que aparecía en otros tiempos.Ese cambio en el relacionamiento público-privado se percibe en las distintas modalidades de privatización, tanto en las negociales como en las institucionales, así como en la liberalización. En las dos primeras no aparecen novedades esenciales sino más bien accidentales o determinados énfasis cuantitativos. Las novedades más importantes aparecen en la liberalización y, sobre todo, en la postura del Estado y de la sociedad de cara al cumplimiento de los cometidos estatales en función de una perspectiva desde los derechos humanos.

    Abstract. Today’s world is moving from a Legislative State to a Constitutional State on the one hand, and from a Welfare State, which had originally substituted the Liberal State, to a Subsidy State on the other hand. This causes particular concern over the common good and the efficiency of state actions, generating a change in the duties of the State and their attainment, and is evidencing a public-private relationship different from the one in the past. This change in public-private relationships is perceived in the different privatization types, both negotiable and institutional ones, as well as in the liberalization.The first two do not show any material changes; they are rather accidental or of a certain quantitative emphasis. The most important changes occur in the liberalization and especially in the place the State and society have taken when facing the fulfillment of the duties of the State, from the human rights point of view.
