La interpretación del término "población civil" como elemento del tipo en el crimen contra la humanidad

    El objeto de protección del crimen contra la humanidad se concretó, en su primera tipificación internacional, en la población civil. Esta limitación estuvo condicionada por los acontecimientos históricos y políticos anteriores a laaplicación del tipo penal en el Tribunal Militar Internacional de Núremberg. No obstante, esa limitación del objeto deprotección sigue acompañando al tipo penal, a pesar de que el mismo pueda ser cometido en tiempos de paz. En esteartículo se analiza si existe un fundamento político criminal para seguir manteniendo dicha limitación y se proponeeliminar el término “población civil” del delito de lesa humanidad.

    The civil population was identified as the goal of protection of the crime against the humanity, in its firstinternational enforceable article of law. This limitation was produced due to the historical and political developments, before the application of the crime against humanity in the Nuremberg International Military Tribunal. However, thislimitation of the protection upon this object continues occurred nowadays, even though the crime is committed in peacetime. This article questions whether exist a real criminal ground for maintaining this limitation and also suggest erasingthe concept “civilian population” of the crime against humanity.
