Como es sabido los distintos Planes de Pago a Proveedores implementados por el Ejecutivo español a lo largo de estos últimos años han incluido como una cláusula inherente a los mismos la renuncia por parte de aquellos proveedores que se adhiriesen a dichos planes al cobro de los intereses de demora devengados y de los costes de cobro existentes en beneficio del deudor (Comunidades Autónomas y Entes Locales, especialmente) y en detrimento del acreedor. A lo largo del presente trabajo, y a la luz de la reciente doctrina jurisprudencial dictada al respecto, se analiza la compatibilidad de dicha regulación con el ordenamiento comunitario. En fechas pasadas el TJUE ha tenido ocasión de pronunciarse al respecto, a resultas de una cuestión prejudicial planteada por un tribunal español.
As it is known, the various Payment Plans to Suppliers implemented by the Spanish Executive over the last few years have included as an inherent clause the resignatíon on the part of those suppliers who adhere to these plans 10 collect the interests of delays and the costs of recovery for the benefit af the debtor (Autonamous Communities and Local Authorities, especially) and to the detriment of the creditor. Throughout this paper, and in light of the recent jurisprudential doctrine dictated in this respect, we analyzes the compatibility of this regulation with the community arder. In past times, the ECJ has had occasion to pronounce on this, as a result of a question referred by a Spanish court.
