Resumen de Die ProzeBordnung in bürgerlichen Rechtsstreitigkeiten des Konigreiches Bayern von 1869: Zur Entwicklung eines modernen Zivilverfahrensrechts auf dem WegzurZPO

Petr Kreuz

  • The Civil Procedure Law of the Kingdom of Bavaria of 1869 - On the development of a modern civil procedure law on its way to ZPO. The 19th century Germán civil procedure law was characterized by an antagonism of two schools: One was influenced by the French law, especially by the Code de Procedure Civile, and lead to the so-called Rhenish-French procedure.

The other tried to retain the principies of the common procedure law, a great example of which is the Civil Procedure Code of the Kingdom of Hannover from 1850. The Civil Procedure Code of the Kingdom of Bavaria from 1869 stands for the modern concept of the Rhenish-French civil procedure law. Its main principies were taken over by the Civil Procedure Code of the newly founded Germán Empire. It is in forcé since 1879.
