    ¿Por qué cumplimos el derecho? Es la pregunta que se trata de resolver en este ensayo, a través de la comparación y contraste del positivismo crítico de H.L.A. Hart y el realismo jurídico de Javier Hervada. Hart expone como la obediencia pacífica de la norma se funda en la aceptación voluntaria de la norma y la disposición de ejecutar medidas de coerción que asegure su cumplimiento. Por su parte, Hervada ubica la obediencia del derecho, en la justicia, en la necesidad de una correcta relación, entre el sujeto, su título o derecho y la cosa. La obediencia al Derecho tiene su fundamento en más de una perspectiva o argumento. Es imposible dar una respuesta adecuada sino se analiza la interrogante de forma holística. Ambas teorías deben complementarse y no excluirse. En su conjunto, los aspectos formales del derecho, la aceptación y coerción social, y la justicia como perspectiva esencial del Derecho, permiten comprender de manera más precisa la obediencia a la ley.

    Why we obey the law? Is the question that this essay tries to solve, through the comparison and contrast of H.L.A. Hart’s positivism and Javier Hervada’s legal realism. Hart explains how the pacific obedience of the law has its foundation in the voluntary acceptance of the rule and the disposition of enforcing the law in order to reach its fulfillment. Meanwhile, Hervada locates the obedience of the law in justice, in the necessity of the appropriate relation between the subject of the law, his title or right, and the thing object of his right. The obedience to the law has its foundation in more than one perspective or argument. It is impossible to find an adequate response if the question is not approached in a holistic way. Both theories should complement themselves, not exclude between themselves. It is in its integration, that the formal aspects of the law, the acceptance and social pressure, and justice as an essential element, allow us to comprehend in a more precise way why we obey the law.
