La figura del control de convencionalidad desarrollada mediante la jurisprudencia de la Corte Interamericana de Derechos Humanos se ha constituido en los últimos años, en uno de los mecanismos más invocados para la protección de los derechos humanos en la función judicial. Esta herramienta, que consiste en la confrontación de las normas nacionales con el contenido de la Convención Americana sobre Derechos Humanos y con la jurisprudencia emanada de la Corte Interamericana, ha empezado a ser efectivamente aplicada en las sentencias de los tribunales constitucionales en América Latina y particularmente en Guatemala, donde si bien, su desarrollo es incipiente, es posible vislumbrar un importante desarrollo a futuro.

The figure of the control of conventionality developed through the jurisprudence of the Inter-American Court of Human Rights has constituted in recent years, one of the most invoked mechanisms for the protection of human rights in the judicial function. This tool, which consists of the confrontation of national rules with the content of the American Convention on Human Rights and with the jurisprudence of the Inter-American Court, has begun to be effectively applied in the judgments of the constitutional courts in Latin America and in particular In Guatemala, where, although its development is incipient, it is possible to glimpse an important development in the future.
