    Este trabajo aborda la cuestión de cuál sea el fundamento de los derechos humanos y cómo pueda hablarse de éstos en términos en los que parece que ni el iusnaturalismo ni el iuspositivismo han sido capaces, más allá de su autoevidencia o imposición. En este contexto, la apelación a los valores parece aportar una alternativa para argumentar la dignidad humana y los derechos humanos. En esta dirección, el autor conversa con Luis Neil sobre cuál pueda ser el papel de la fenomenología en la justificación del fundamento universal de los derechos humanos. Para ello, se acude al trabajo de Edith Stein y al de Adolf Reinach como dos autores cuyas obras, propiamente fenomenológicas, pueden aportar luces a las reflexiones que Niel lleva a cabo intentando abordarlos a partir de la filosofía de Husserl, afirmando la prioridad de la persona ante el Derecho.

    This paper raises the question of the foundation of Human Rights and the way in which we may be able to talk about them in terms that neither iusnaturalism or iuspositivism seem to be able to, beyond the opposition between their self evidence or their imposition. In this context, an appeal to the values appears as an alternative to argue human dignity and Human Rights. In this direction, the author stablishes a dialogue with Luis Neil on which it may be the role of phenomenology in the universal foundation of Human Rights. Therefore, he shows how the works of Edith Stein and Adolf Reinach can help us to follow Niel’s reflections on the priority of human dignity before Right, as he does following Husserl’s philosophy.
