La presente contribución desarrolla la noción de patent governance como modelo teórico de funcionamiento del sistema de patentes. La gobernanza del sistema de patentes a sus diferentes niveles, nacional, regional e internacional, desafía la concepción y diseño tradicional estático del sistema ordenado por autoridades de examen y concesión nacionales, con la emergencia de actores en red, nuevas relaciones horizontales y mecanismos participatorios. La gobernanza se integra a la dimensión pública de la patente y sus mecanismos de intervención pública ex ante y ex post en el ejercicio, ofreciendo reinterpretaciones del sistema articuladas desde este segmento preterido en el derecho de patentes.

This work deals with the patent governance as theoretical model for improving the functioning of the patent system. It provides an approach to the patent governance at the various levels, international, national and regional, that challenges the traditional, static patent system based on the central role of the examination and granted office by the new heterogeneous actors, relations between these actors and participatory mechanisms within the patent system. Patent governance impacts the institutional dimension formed by the tools and mechanisms of public intervention. It exposes a new physiognomy of the patent system that invites to rethink the patent law functions and objectives.
