    Este trabajo analiza el objeto del artículo 18.3 CE -el secreto de las comunicaciones- a la luz de la revolución tecnológica habida desde la aprobación de la Constitución Española. Se concluye que existen discordancias entre el objeto protegido en la norma de derecho fundamental -el secreto del proceso de las comunicaciones- , y el protegido por la jurisprudencia y la doctrina inicial -el secreto del proceso técnico de las comunicaciones-. Se precisa que el art. 18.3 CE protege el proceso de las comunicaciones, o el transcurso de lo que se comunica o se pretende transmitir por el emisor al receptor, por lo que la interceptación de las conversaciones y de las comunicaciones tienen la misma protección iusfundamental.

    The object of Article 18.3 EC -the secret of communications - and its content - the protection of the formality of ommunications and the possibility of intervening by means of a judicial decision -has been analyzed in the light of the technological revolution since the adoption of the Spanish constitution. It has been argued that there is disagreement between the protected object in the norm of fundamental right -the secret of the communications process -and the one protected by jurisprudence and the initial doctrine -the secret of the technical process of communications. It has therefore been concluded that the interception of the talks and communications have the same fundamental protection.
