La Ley 27/2013, de 27 de diciembre de 2013, de Racionalización y Sostenibilidad de la Administración Local (LRSAL), había introducido importantes novedades en el régimen local español. Con el objetivo de la estabilidad presupuestaria, la LRSAL regulaba cuestiones hasta ahora ajenas a la legislación básica estatal e introducía múltiples restricciones a la autonomía local. Esta ley fue impugnada de forma múltiple ante el Tribunal Constitucional, que en 2016 ha dictado ya sus primeras sentencias. Aunque en términos generales el Tribunal Constitucional es deferente con la ley actual, es contundente con aquellas normas de la LRSAL que más notoriamente habían alterado el sistema constitucional: las relativas a las competencias municipales, y la atribución de poder presupuestario a la junta de gobierno local. Con todo, lo más relevante de esta nueva jurisprudencia (en especial, en las SSTC 41/2016 y 111/2016) está en su calidad argumental y en su trascendencia sistemática para el conjunto del Derecho local.

Law 27/2013, of 27 December 2013, on Rationalization and Sustainability of Local Administration (LRSAL), has introduced important developments in the Spanish local system. Under the objective of budgetary stability, the Law regulated issues hitherto outside the basic state legislation and introduced multiple restrictions on local self-government. This law was challenged before the Constitutional Court, which in 2016 has already issued its first rulings. Although in general terms the Constitutional Court is deferential with the state law, it is conclusive with those rules of the LRSAL that most notably had altered the constitutional system: those related to the municipal competences, and the attribution of budgetary power to the local government board. However, the most relevant of this new jurisprudence (especially in SSTC 41/2016 and 111/2016) is in its argumentative quality and in its systematic importance for the local government law.
