La incidencia de la prescripción penal en la prescripción tributaria

    Las normas que imponen la interrupción y la suspensión del cómputo del plazo de prescripción tributaria mientras esté conociendo la jurisdicción penal, no pueden aplicarse con independencia de la efectiva actividad de los Tribunales. De tal modo que si, por ejemplo, el proceso penal no se dirigiera contra al presunto culpable y llegara a consumarse la prescripción del delito por dicha causa, también podría producirse la prescripción tributaria. Dicho en otros términos: la seguridad jurídica que informa la institución de la prescripción tributaria no puede sacrificarse cuando existe una doble inactividad administrativa, en el procedimiento administrativo y en el proceso penal. Esa falta de actuación en el proceso se traduce en la imposibilidad de entender suspendido el cómputo del plazo de prescripción tributaria, a pesar de lo que establecen las normas.

    The regulations imposing the interruption and suspension of the counting of the tax expiry period while the penal jurisdiction is on cannot be applied separately from the effective activity of the Courts. Therefore, if, for example, the penal process was not directed against the suspected guilty party and the crime expired as a result, the tax expiry might also occur. In other words, the legal security entailed in the establishment of the tax expiry cannot be waived when there is double administrative inactivity, i.e. in the administrative and penal proceedings. This lack of action in the process results in the impossibility to consider the counting of the tax expiry period as suspended, despite what is set forth in the regulations.
