Resumen de La despenalización del aborto en Argentina. Disputas en torno a la narrativa legal

Este texto pretende, a la luz principalmente de los textos de la Antropóloga Rita Segato trabajados en el seminario «Estructuras elementales de la violencia», analizar los dispositivos que sustentan la falta de tratamiento legislativo de los proyectos que buscan legalizar el aborto en argentina.El texto además, busca visualizar los sustentos simbólicos para la falta de inscripción legal de la práctica abortiva, las tensiones que allí se despliegan, los sujetos en pugna y los terrenos de disputas que se presentan.Analiza además el rol fundamental del Estado y la ley como la herramienta discursiva del mismo, en cuanto lugar de sujeción de las mujeres. En este análisis se busca visualizar el traspado desde el colonialismo a la instalación del Estado moderno y las implicancias en la privatización de las prácticas abortivas.Por último el texto pretende delinear perspectivas en pos de la inscripción de la práctica abortiva en la narrativa legal.

This text pretend, under the light of the texts of the anthropologist Rita Segato, worked at the seminar called “Elementary structures of the violence”, analyce the devices that sustain the lack of legislative treatment of the projects that pretend legalize the abortion in Argentina. The text pretend view the symbolic supports to the lack of legal registration about the abortion practice, the tensions in which they are deployed, the subjects in conflict, and the presented areas disputed, too. Analyse the fundamental role of the State and the law as a discursive vehicle of the same, in respect the hold-down place of women. This analysis pretends visualize the transfer from colonialism to the modern state consolidation and the implicatios of the abortion practice privation. For the last, the text pretend delineate perspectives in favor of the inscription of the abortion practice to the legal narrative.
