    En este trabajo he querido hacer referencia a un momento muy significativo de la historia del derecho penal en Alemania: el que comprende las tres décadas que preceden  la llegada de la dictadura nacionalsocialista, proponiéndome contribuir, con una documentación histórica, a un juicio más sereno sobre la relación entre el positivismo jurídico y la degeneración autoritaria del ordenamiento jurídico alemán, después de 1933.

    In this paper, I refer to a very significant chapter in the German history of criminal law: the one that includes the three decades preceding the arrival of the National Socialist dictatorship. With historical documentation, I intend to contribute to a more serene judgment on the relationship between legal positivism and the authoritarian degeneration of the German legal system after 1933.
