  This paper examines the question of whether solidarity is a legal principle in the relations among nations. It starts by distinguishing between the different meanings of the word "solidarity" in private law, sociology and moral discourse. It then draws the attention to a crucial problem: the definition of the appropriate sphere of solidarity. In other words, to whom should we practise solidarity? At this point, two examples are used to test to what extent solidarity works as a legal principle in international relations: one is the new idea of "responsibility to protect", that operates in public international law; and the other is the EU response to the sovereign debt crisis, that has to do specifically with the process of European integration. Whereas solidarity is not yet a true legal principle in public international law, it can be said to have such nature in EU law. In this field, however, the real problem is not so much solidarity, as democracy.

  Ce rapport examine la question de savoir si la solidarité est un principe juridique dans les relations entre les nations. Il commence par distinguer les différents sens du terme "solidarité" en droit privé, la sociologie et le discours moral. Ensuite, il attire l'attention sur un problème crucial: la définition de la sphère appropriée de la solidarité. En d'autres termes, envers qui devons-nous pratiquer la solidarité? A ce stade, deux exemples sont utilisés pour tester dans quelle mesure la solidarité fonctionne comme un principe juridique dans les relations internationales: l'un est la nouvelle idée de la "responsabilité de protéger", qui opère dans le droit international public; et l'autre est la réponse de l'UE à la crise de la dette souveraine, qui a à voir précisément avec le processus de l'intégration européenne. Malgré le fait que la solidarité ne constitue pas encore un véritable principe juridique en droit international public, elle peut être considérée comme ayant cette nature en droit de l'UE. Dans ce champ, pourtant, le véritable problème ne réside pas tant en la solidarité qu'en la démocratie.
