The paper offers a presentation and anaysis of a series of texts from the Digest that contain the expression "vacua possessio". It is shown how the term "possessio" is not univocal but has a plural meaning: sometimes means "res"; others, "factum" (either it refers to the moment or to the situation of a holding); and others, "ius". Special attention is paid to the fragment D.43.16.18pr. (Pap. 26 quaest)
